TIG Seeks to Declaratory Judgment on Duty to Defend NHL

The liability carrier for the National Hockey League is seeking a declaratory judgment limiting its duty to defend the league from two pending concussion injury lawsuits by former players.Both lawsuits seek certification as class actions against the NHL for allegedly failing to protect players from head injuries, and concealing the risk of long-term brain problems from repeated concussions. The NHL had liability insurance with the TIG Insurance Co., a New Hampshire-based unit of Fairfax Financial Holdings Ltd., for various periods from 1989 to 2001.TIG filed a declaratory relief action la...
