N.Y. Employer Defeats Indemnification Claim From Property Owner

A New York water company lost its bid for indemnification from an employer after a worker fell from his ladder while removing a water tower from the company's property. The 3rd Appellate Division of the New York Supreme Court affirmed the granting of an employer's motion for summary judgment against the water company, after concluding that workers' compensation law prevented the water company from being entitled to indemnification from the employer.
