The Minnesota Supreme Court ruled that a claim for payment of medical expenses incurred to treat a work-related injury is not barred by res judicata if the right to seek reimbursement for those expenses had not arisen at the time of the previously denied claim.
A medical expense claim is also not barred by collateral estoppel if the facts establish that the employee’s condition has changed since the time of the previously denied claim.
