Worker Sues City, Alleging Retaliation for Comp Claim

A fourth employee filed a lawsuit alleging that North Myrtle Beach fired him in retaliation for filing a workers’ compensation, according to a report by a South Carolina media outlet.

MyHorryNews.com reports Davis Livingston, former superintendent of pumping stations, broke bones and dislocated his ankle while giving blood during a work-sponsored event in March 2018.

He was on medical leave and hired an attorney to pursue his workers’ compensation case after the city’s carrier refused to pay for ankle reconstruction, according to the report. Livingston reportedly needed a second surgery in February 2019 and returned to work in June 2019.

He says he was placed on administrative leave May 29, 2020, and told that his behavior was erratic since returning from the ankle injury when he was fired July 27, 2020.

His lawsuit alleges the city defamed him by making false allegations, illegally retaliated for filing a work comp claim and violated the Americans with Disabilities Act.

The city did not comment on the case.
