New York independent medical examiners would gain more authority over injured workers under proposed regulatory revisions related to schedule loss of use determinations and impairment guidelines. The proposed changes would require claimants to cooperate fully with independent medical examiners (IMEs) or medical providers, or risk the loss or denial of benefits. Claimants would have to “truthfully complete any questionnaire or intake sheets” provided by IMEs and to answer any questions during the examination, the proposal states.
