A Texas defense attorney made a costly mistake in failing to introduce all of the evidence in support of an employer's exclusive remedy affirmative defense at trial.The 11th Court of Appeals on Thursday explained that it would not consider exhibits or affidavits which had not been before the jury that issued an award of $1.67 million in favor of Kenneth Thompson for a workplace injury to his arm in ruling on the propriety of the verdict.The case was Synergy Management Group v.
