Bill Proposes Causation Standard for Mesothelioma Claims

Sen. Robert Duncan, R-Lubbock, introduced legislation Wednesday relating to the standard of causation in claims involving mesothelioma caused by exposure to asbestos fibers.Senate Bill 1123 would amend Chapter 90 of the Civil Practice and Remedies Code by adding Section 90.013 to provide “the exclusive  means of proving causation for claims in which the claimant seeks recovery for malignant mesothelioma allegedly caused by exposure to asbestos fibers.”Under SB 1123, a claimant would be required to provide that “a defendant's product or conduct was a substantial facto...
