The Maryland Appellate Court ruled that the exclusive remedy rule did not bar three workers from maintaining a tort suit against a warehouse operator arising from a mass shooting as a matter of law, but their claims failed because they could not show the attack was a reasonably foreseeable event.
A mass shooting happened on Sept. 20, 2018, at a warehouse facility leased by Rite Aid of Maryland Inc., in Aberdeen. The shooter was 26-year-old Snochia Moseley.
Mosley was an employee of Abacus Staffing Corp., a temporary employment agency, and had been at the facility for about two weeks.
