Constitutional Challenge to Lien Stay Dismissed

The U.S. District Court for Central California dismissed the 18-month-old constitutional challenge to the statutory stay on liens filed by criminally charged providers. At the same time, U.S. District Judge George H. Wu on Nov. 28 lifted the preliminary injunction that prohibited the Division of Workers’ Compensation from treating as stayed any lien in which the claimant wasn’t included on the list of providers whose liens are subject to the automatic stay created by Senate Bill 1160.
