California's 1st District Court of Appeal last week ordered publication of its decision that a class action can proceed against a San Francisco hospital for allegedly overcharging patients whose attorneys sought access to their medical records.
When the court originally released its decision in Nicodemus v. Saint Francis Memorial Hospital, No. A141500, on Sept. 14, it was unpublished, meaning it could not be citable case law in any other lawsuits.
Publishing the decision makes it binding precedent in California, should a similar factual scenario arise in another case.
