The Vermont Supreme Court last week ruled that an employer’s alleged failure to comply with safety regulations is not sufficient to meet the level of intent necessary to circumvent the workers' compensation system as an exclusive remedy for an injured employee.
Ordinarily, if a worker is injured “by accident,” he is limited to a recovery under the workers’ compensation system, and the Supreme Court on Friday said that nothing short of evidence of an employer’s specific intent to injure will allow a worker an alternative remedy via a tort claim.
