Utah's Supreme Court justices could not decide whether a worker's condition — linked to cumulative trauma — should be classified as an occupational disease or an accidental injury, in an opinion released last week.
Because of the indecision, the Labor Commission's opinion stood in Rueda v. Labor Commission. The commission had classified Genoveva Rueda's condition as an injury.
Judges and workers' compensation lawyers alike classified the 110-page decision as, in one lawyer's words, "a mess."
