Court Reinstates Comp Carrier's Lien against Worker's 3rd-Party Recovery

A New York appellate court reinstated a comp carrier's lien against a worker's settlement recovery from a third-party tortfeasor. Case: Klem v. Special Response Corp., No. 1392 CA 13-01879, 02/13/2015, published. Facts: Dorsie Klem, an employee of Corning Hospital, injured her ankle while disembarking from a van operated by the Special Response Corp., which transported hospital employees to and from a parking lot.  The hospital's comp carrier, the Zurich Insurance Co., paid Klem $114,028 in workers' compensation benefits.
