Widow's Claim for Death Benefits Rejected as Untimely

A divided New York appellate court upheld a denial of a widow’s claim for benefits, finding her claim was not timely filed. Case: Matter of Garcia v. WTC Volunteer, No. 533993, 12/15/2022, published. Facts: Miguel Garcia volunteered at the World Trade Center in the aftermath of the Sept. 11, 2001, terrorist attacks. Garcia later established his entitlement to workers’ compensation benefits for his post-traumatic stress disorder, depression, asthma, gastroesophageal reflux disease and obstructive sleep apnea.
