Court Overturns Summary Judgment for Worker Struck by Hoist Elevator

A New York appellate court overturned a grant of summary judgment in favor of an injured worker on his Labor Law claims from being struck by a hoist elevator. Daniel Lopez worked for S&E Bridge and Scaffold LLC. He suffered injuries while fixing a misaligned hoist elevator at a construction site. Lopez was on the hoist tower attempting to loosen a screw when an adjacent ascending hoist elevator struck his foot, causing injury.
