The Oregon Workers’ Compensation Division posted proposed changes to its rules to incorporate a state Supreme Court decision finding that an otherwise compensable injury as part of a combined condition includes only what the employer accepted to be compensable.
The division said it is proposing new rules that would reflect the court’s interpretation in Brown v. SAIF Corp. The proposed changes incorporate the court’s finding that an “otherwise compensable injury” refers to a medical condition and not to an injury incident.
