New York workers would be allowed to sue their employers for unlawful retaliation rather than pursue administrative complaints before the State Workers' Compensation Board under a bill introduced Monday.
Current law prohibits employers from summarily firing or failing to reinstate employees who file workers' compensation claims, who request work comp claim forms or who testify in work comp proceedings. Workers who believe they've suffered an unlawful discriminatory practice can file a complaint with the WCB within two years.
