Gradual Worsening of Worker's Condition Was Not New Injury

A worker who returned to work after a compensable injury only to have her condition progressively worsen did not suffer a "new injury" when she deteriorated to the point she could no longer work, but rather experienced a change in condition, the state Supreme Court ruled.
