A New York appellate court ruled that a worker should have been granted summary judgment on his Labor Law claim. Case: Garcia v. 122-130 East 23rd Street LLC, 10/10/2023, published. Facts: Jose Garcia allegedly suffered injuries in a fall from a scaffold while doing taping work around lights on the ceiling of a garage at a construction site. Garcia said he and a co-worker were instructed to retrieve pieces of the scaffold, which were stored a block away, and assemble them for the taping work.
