A Pennsylvania court of appeals told a claimant who stopped receiving her benefits that the Workers' Compensation Security Fund can't be penalized for the violation.
The insurer in the case was liquidated, and its workers' compensation liabilities were transferred to the Security Fund. The fund's third-party administrator mistakenly stopped paying Candace Mitchell her partial disability benefits over a two-month period from June 13 through Aug. 15, 2005, according to the court record.
