The Oregon Workers’ Compensation Board will discuss several issues relating to attorney fees, including a proposal to have a separate proceeding to determine a reasonable rate, and increasing the investigative statement fee.
The board’s attorney fee advisory committee in July voted to propose allowing claimants’ attorneys to bifurcate the assessed fee issue when their clients prevail. The amount of the fee would be determined in a separate proceeding after the question of compensability is resolved with a final judgment, under the proposal.
