3rd DCA Gets Amicus Briefs Backing FWA in Challenge to Constitutionality of Comp System

The 3rd District Court of Appeal last week accepted two more amicus briefs in the pending dispute over whether Florida's comp system can continue to serve as the exclusive remedy for the state's injured workers. Miami-Dade Circuit Court Judge Jorge Cueto stunned system participants last August when he ruled that the benefits available to workers under the comp system had become so decimated that a workers' comp claim was no longer an adequate substitute for a tort cause of action, as a matter of law.
