FedEx vowed to keep fighting a U.S. 9th Circuit Court of Appeals ruling this week that its workers are employees, not independent contractors, but a lead plaintiff's attorney said the company has little chance of success.
FedEx said in a Wednesday statement that it would pursue further review of the rulings, both by the three-member panel that decided the case and by an en banc panel of the court. The press release didn't elaborate on whether the company would consider going to the U.S. Supreme Court.
