Pa. Employer Loses Bid for Reimbursement in Benefits Suspension

An employer lost its bid for reimbursement after successfully suspending benefits to an employee who refused medical treatment because it did not seek forfeiture, a Pennsylvania Commonwealth Court ruled.The court ruled that the employer was not entitled to recouping about 16 months of compensation, in Land O'Lakes, Inc. v. WCAB, No. 1085 C.D. 2007, 2/11/08. Claimant Lester Todd had allegedly refused medical treatment that would have improved his condition.
