The Court of Appeal for the 1st District of California has ordered publication of its decision from late last month finding the state Department of Transportation could not be held liable for the death of a contractor’s worker who was struck by a drunk driver.
The court’s decision in Marin v. Department of Transportation, No. A161844, was originally released on Jan. 31 as an unpublished decision. Unpublished opinions are not binding precedent in California.
