The 1st District Court of Appeal has granted a writ of review of a Workers' Compensation Appeals Board ruling that Education Code benefits are different from temporary total disability benefits and not subject to the state's 104-233k cap on temporary total disability payments.The appellate court will review the Feb. 26 WCAB panel decision that benefits described by Section 44043 of the Education Code do not constitute temporary total disability (TTD) benefits, which would mean they are not subject to the cap.The name of the case at the appellate court is Mt.
