Some states, including New York and California, prosecute employers who fail to obtain workers' compensation coverage for their employees.
In West Virginia, it's a civil process, in which the state's insurance commissioner asks a judge for an injunction against the company.
"They have to get coverage or they have to shut down," said David Ansell, attorney for the West Virginia Insurance Commissioner's Office. "And nine out of 10 usually go ahead and get the coverage."
