The New Mexico House of Representatives passed a bill to increase attorney fees as well as the amount of discovery costs that employers can be ordered to advance to injured workers.
The House voted 36-22 on Wednesday to pass an amended version of HB 66, by Rep. Pamelya Herndon, D-Bernalillo.
As introduced, the bill would have doubled the discovery advance amount to $6,000 from $3,000. It would have increased the cap on attorney fees to $30,000 from $22,500 in 2025, and it would have required annual increases for inflation starting in 2026.
