A New York appellate court rejected an injured worker’s claim that his employer’s comp carrier had failed to timely pay his award of benefits. Case: Matter of Sweeney v. Air Stream Air Conditioning Co., No. 526761, 12/13/2018, published. Facts and procedural history: Charles Sweeney III worked as a heating, ventilation and air conditioning technician. He injured his right arm while at work in 2016. His employer and the State Insurance Fund stipulated that the injury had caused Sweeney a 30% schedule loss of use of his right arm.
