The Superior Court of Pennsylvania revived a former merchant marine's claim for Jones Act negligence premised on his injurious exposure to asbestos.

Facts: Earl Criswell filed Jones Act negligence claims against Sunoco and the Atlantic Richfield Co. He alleged that the defendants had been responsible for exposing him to asbestos during his time as a member of the Merchant Marine.
Criswell died of lung cancer during the pendency of his case, and his estate then took over as the plaintiff.
