A New York appellate court on Thursday revived the State Workers' Compensation Board's breach-of-contract claim against the former administrator of the Builders' Self-Insurance Trust.
Marsh USA, an international insurance brokerage and risk management firm, began handling the trust's claims in 2001. The trust stopped offering coverage six years later, after developing a deficit of $5.9 million.
The board took over the administration of the trust in May 2009. By that time, it was $11.98 million in the red.
