Worker Can't Simultaneously Pursue Comp Claim, Intentional Tort Action

The Oklahoma Supreme Court unanimously ruled that a worker timely filed a civil suit against a defendant he had failed to name in the caption of his original petition, but split over the worker’s ability to pursue an intentional tort claim against his employer while his workers’ compensation claim was pending.   Mwande Serge Kpiele-Poda suffered injuries in 2018 while attempting to repair a conveyor at a well site.
