Governor Signs Bill Reducing Ownership Threshold for Comp Exemption

Montana Gov. Greg Gianforte enacted a bill lowering the ownership threshold for corporate officers and managers to be exempted from workers’ compensation. Montana law designates certain jobs and positions for which it is presumed the state comp act doesn’t apply unless the employer elects coverage and the insurer allows the election. House Bill 636 lowers the ownership threshold — from 20% to 10% — at which it is presumed officers and managers are exempt from comp coverage unless they voluntarily select coverage.
