Court Says PTD Award to Worker With Full-Time Job Cannot Stand

The Kentucky Court of Appeals ruled that an injured worker was not entitled to an award of permanent total disability benefits after he had returned to full-time employment. Case: Lotter v. General Electric Co., No. 2016-CA-001648-WC, 01/19/2018, unpublished. Facts and procedural history: Daniel Lotter began working for the General Electric Co. in 1994. He injured his back while at work in April 2014, and again in March 2015. Lotter filed a workers’ compensation claim in July 2015. In April 2016, an administrative law judge found that Lotter was permanently and totally disabled....
