The Colorado Division of Workers’ Compensation will hold a hearing in October to discuss permanently adopting temporary rules clarifying that an admission of liability is required after an initial award of benefits.
The division said it adopted emergency rules to that effect Aug. 28.
The emergency rule modifies Rule 5-5(C)(1) by clarifying that an order that awards benefits triggers the requirement to file an admission of liability. Before the emergency rules took effect, the regulation required admissions only when a final order altered benefits.
