A Louisiana appellate court ruled that a worker who fell while leaving her workplace to visit with her daughter could not proceed with a tort claim against her employer.
Case: Holden v. Mike’s Catfish Inn, No. 2017 CA 1056, 02/27/2018, published.
Facts: Jackie Holden worked for Mike's Catfish Inn. While she was at work on July 14, 2015, one of her coworkers informed her that her daughter had come to the restaurant and was waiting for her in the parking lot.
Holden exited the building without clocking out, although the inn permitted its employees to take breaks without doing so.
