Supreme Court: Subcontractor Was Immune From Civil Liability

The Texas Supreme Court on Friday ruled that a subcontractor covered by a general contractor's workplace insurance plan is immune from civil liability if its negligence causes injury to the general contractor's employee. Although the Texas Labor Code provides that a subcontractor is not an employee of a general contractor if the subcontractor is operating independently, a separate provision says that a general contractor is the subcontractor's employer if the general contractor is providing comp coverage for the subcontractor.
