A divided Ohio Supreme Court this week ruled that a trial judge should have thrown out an injured worker’s challenge to the state’s debit card program for payment of benefits because he picked the wrong court in which to pursue his claim.
In Ohio, suits seeking declaratory, injunctive or other equitable relief against the state can be brought in the Court of Common Pleas, but claims for money damages from the state must be filed in the Court of Claims.
