Exclusivity bars a civil racketeering complaint filed by a group of first responders accusing two cities and their third-party administrators of conspiring to delay and deny claims, the California Workers’ Compensation Institute said in an amicus brief filed with the U.S. 9th Circuit Court of Appeals.
CWCI said the first responders lack standing to bring their claim because they can’t show they have a vested property right to receive workers’ compensation benefits.
