OSHA Proposing Maximum Fines Against Plant Where Employee Fell

An accident that seriously injured an employee who fell 30 feet at plant in Millport prompted more than $200,000 in proposed penalties against two companies, the U.S. Occupational Safety Administration said.

OSHA said it levied the maximum allowable penalty against Thorpe Specialty Services Corp. — $175,528 — for exposing employees to fall hazards. It also is proposing $28,270 in penalties against Steel Dust Recycling LLC.

OSHA said Thrope also failed to conduct atmospheric monitoring before allowing employees to enter a confined space, and failed to follow proper procedures to protect employees from confined-space hazards. 

OSHA cited Steel Dust for exposing employees to fall hazards and failing to implement a confined-space permit entry program. 

“Both companies’ failure to comply with fall prevention requirements led to a serious injury that could have been prevented,” stated OSHA Birmingham Area Office Director Ramona Morris.

The companies have 15 business days from receipt of the citations and proposed penalties to comply, request an informal conference with OSHA’s area director, or contest the findings before the Occupational Safety and Health Review Commission.
