The Montana Workers' Compensation Court (MWCC) late last week issued an opinion holding that Liberty Northwest and Liberty Mutual, and all Plan II insurers and Plan I self-insured employers are authorized to withhold amounts claimed by petitioner's counsel in the Stavenjord case as attorney fees from other cases that are affected by his pursuit of an action to the Supreme Court that resulted in additional benefits to others being made available.The original case that the MWCC refers to is Stavenjord vs. Montana State Fund, 2003 MT 67,(No. 01-630, 04/01/03), where the Supreme Court ruled that ...
