Colorado Division of Workers' Compensation Director MaryAnn Whiteside issued an interpretive bulletin stating noncompliance by a claimant with medical treatment requirements does not equal maximum medical improvement (MMI).
"A provider should not be asked to place a claimant at MMI simply because the claimant fails to attend medical appointments or is otherwise non-compliant with treatment recommendations," the bulletin states.
