Counsel fees should be denied when credibility is an issue, the Commonwealth Court of Pennsylvania ruled.
In Frankford Hospital v. Workers' Compensation Appeal Board , No. 2320 C.D. 2005, 08/15/2006, Tanya Walsh worked for Frankford Hospital as a medical assistant. Walsh filed a claim petition on May 2, 2003, alleging that she sustained a work-related injury. At the trial hearing, Walsh testified that on Dec. 24, 2002, she felt a snap in her back while attempting to lean over her desk and pick up a Plexiglas window.
