Texas 9th: 7-Day Deadline Never Raised at Hearing

A trial court erred in reversing a panel's decision for judicial review because the claimant did not demonstrate he had claimed that the provider failed to comply with the seven-day deadline to pay or to file a notice of refusal, the Texas 9th District Court of Appeals ruled. The court overruled the trial court in American Home Assurance Co. v. Frazier, 09-05-322 CV, 11/22/06. The insurer, American Home, challenged the judgment in favor of William Frazier.
