US 7th: 46 Year Smoker Gets Black Lung Benefits

The United States Court of Appeals for the Seventh Circuit held that a claimant who worked in the coal mining industry for over 13 years was entitled to benefits for lung disease, despite the fact that the claimant smoked a pack of cigarettes a day for 46 years. In Roberts & Schaefer Co. v. Director, No. 04-2030, 03/14/2005, Williams was employed as a coal miner for at least 3 years and worked in the coal mine construction business for many years after that.
