Med Legal Fees; Miceli Update

The DWC has sent its most recent proposed regulations on the Medical-Legal Fee Schedule to the Office of Administrative Law for approval with a proposed effective date of 7/1/06.

These regulations provide the first increase in the Medical Legal payments to physicians for Comprehensive Medical Legal Examinations (CMLE) since the original adoption of the fees in 1994. The new payment schedule gives physicians a 25% increase from the prior rates:

ML-101, 105 or 106 $50 per quarter hour $62.50 per quarter hour
ML-102 $500 per report $625 per report
ML-103 $750 per report $937.50 per report
ML-104 $50 per quarter hour $62.50 per quarter hour
Example: 4 Hr report =$800 Example: 4 hr Report = $1000

The Regulations have also made changes keyed to recent statutory and regulatory changes in the medical legal arena including specific instructions as to when apportionment is considered a complexity factor, as opposed to the prior rules that simply identified apportionment as one of the complexity factors that was to be considered in elevating a report to the ML-103 or ML-104 status. Since apportionment must be addressed in every report pursuant to Labor Code
