Calif. 5th Backs Nonapportioned Knee, Back Award

The Workers' Compensation Appeals Board was not bound to follow a doctor's "prior, inconsistent" opinion that attributed 50% of a Fresno teacher's back and knee injuries to a nonindustrial cause, the California 5th District Court of Appeal ruled. The WCAB was not obligated to follow the doctor's "prior, inconsistent opinion on apportionment," the 5th District Court of Appeal ruled in Fresno Unified School District v.
