Fits of blindness count as permanent disability, the Ohio Supreme Court ruled.
In State ex rel Kincaid v. Allen Refractories Co., 2006-1118, 08/08/2007, the justices ruled that injured worker James Kincaid's episodes of blindness qualify him for permanent total disability.
"The intermittent nature of Kincaid's blindness does not change the fact that he has total loss of sight; there is no evidence that this condition will change," the state Supreme Court wrote.
