Supreme Court Says Injured Worker Using False Identity Can't Pursue 3rd Party Tort Claim

The Louisiana Supreme Court ruled that an injured worker lost his ability to pursue a civil suit he had filed under a false name and an illegally obtained identity. Rafael Antonio Mena Chavez worked for Southern Recycling LLC using the name “Sergio Balboa,” and an associated social security number which he had purchased. He continued to use the alias when he sought medical attention for injuries sustained while working for Southern Recycling, and when he applied for workers’ compensation benefits.
