Excluding time spent resolving medical treatment disputes from the cap on the duration of temporary disability benefits would provide a nominal increase in benefits to a small proportion of injured workers, according to the California Workers’ Compensation Institute.
CWCI said in a statement its review of claims from 2015-2017 found fewer than one in 100 claims were likely to meet the criteria in Assembly Bill 1213. The bill would exclude time spent successfully challenging a medical treatment denial from the 104-week cap on temporary disability benefits.
